Studies of patient decision‐making use many different measures to evaluate the quality of decisions and the decision‐making process, partly to determine whether the ethical goals of informed consent, patient autonomy, and shared decision‐making have been achieved. We describe these measures, grouped under three main approaches, and review their limitations, leading to three conclusions. First, no measure or combination of measures can provide a complete assessment of decision quality. Second, the quality of a decision is best characterized vaguely, for instance as (...) “good,” “satisfactory,” or “poor,” and these categorizations depend on qualitative judgments that go beyond quantitative measures. Third, bioethicists should focus on identifying and addressing poor or problematic decisions, rather than trying to incrementally increase decision quality, quantified by a measure. Decision‐quality measures can be useful in research and in advancing important goals of bioethics, as long as the challenges of defining and measuring decision quality are recognized. (shrink)

The COVID-19 pandemic caused an unprecedented and highly threatening, constrained, and confusing social and educational environment, we decided to expand the traditional focus of the extraneous load in Cognitive Load Theory acknowledging the psychological environment in which learning occurs. We therefore adapted and implemented principles of the CLT to reduce extraneous load for our students by facilitating their educational activities. Given previous empirical support for the principles of CLT, it was expected that the adoption of these principles might enable our (...) students to cultivate attitudes and skills across multiple domains such as online learning and presentation technologies, implementing and maintaining a “classroom atmosphere” in a virtual environment, participating in discussions among large online groups of students, facilitating group work, providing virtual office hours for students, and proactively planning for upcoming semesters. A Nietzschean Bestiary gathers essays devoted to the most notorious and celebrated beasts in Nietzsche's work. The essays illustrate Nietzsche's ample use of animal imagery, and link it to the dual philosophical purposes of recovering and revivifying human animality, which plays a significant role in his call for de-deifying nature.

We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

Although there is a growing recognition that older adults and those with extensive comorbid conditions undergo cancer screening too frequently, there is little information about patients’ perceptions regarding cessation of cancer screening. Information on older adults’ views of screening cessation would be helpful both for clinicians and for those designing interventions to reduce overscreening.

Fanon and the Decolonization of Philosophy explores the range of ways in which Frantz Fanon's decolonization theory can reveal new answers to perennial philosophical questions and new paths to social justice. Internationally, the need to advance science, technology, engineering and mathematics education is recognized as being vital for meeting social and economic challenges and developing a scientifically, mathematically, and technologically literate citizenry. In many countries, however, there are gender differences in the participation and achievement of girls and women in STEM education and STEM careers, usually to the disadvantage of females. This paper aims to identify challenges to female students’ participation in STEM both at post-primary level and beyond in the Irish (...) context. The research questions we aim to address in this paper are: what are student attitudes towards science, technology, engineering and mathematics as measured through interest and perceived ability in STEM, students’ valuing of STEM and students’ commitment to STEM? and what gender differences occur regarding students’ attitudes to science, technology, engineering and mathematics? A survey was completed by 308 post-primary students in Ireland as part of a one-year research project titled “STEMChAT: Women as catalysts for change in STEM education.” Data analysis compiled descriptive statistics, including response frequencies and percentages and median and interquartile range values, and compared gender differences in survey responses using the Kruskal–Wallis H Test. Results indicated that female students had significantly more positive attitudes to science compared to males while in comparison, males had significantly more positive responses to mathematics compared to females. Challenges regarding access to and understanding of STEM in the context of post-primary education are discussed. (shrink)

Pragmata: Festschrift für Klaus Oehler Chiefly in German, this handsomely produced volume, occasioned by the 80th birthday of Hamburg philosopher Klaus Oehler, assembles 31 papers, divided among 4 sections, successively devoted to ancient philosophy, semiotics, pragmatism and topics in modernity. One of the papers appears in French, “La philosophie de la musique dans l’ancien stoicisme,” by Evanghelos Moutsopoulos of the University of Athens. The book also contains 5 papers in English, concentrated in the sections on semiotics and pragmatism, including authors (...) familiar in these pages, such as Richard Robin “Charles Sanders Peirce Then and Now,” and Sandra Rosenthal writing on Peirce’s “neglected argument.” Several of the authors writing in German are also familiar to readers of these pages, including Helmut Pape, Hans Joas and Ludwig Nagl. The book is filled out with a short preface by the editors, a catalogue of the writings of Klaus Oehler from 1989 to 2008 (including mention of recent attention to William James), a comprehensive index of names and information on the contributing authors. The overall design of the book gives the impression of Peircean semiotics and pragmatism mediating between the ancients and modern problems.<br> The editors note some of Oehler’s honors: He received an honorary doctorate from the University of Athens (1993), was the first German President of the C.S. Peirce Society (1982) and in 1998 was awarded the International Prize of the Antonio Iannone Foundation in Rome. The title “Pragmata” is understood to stand for thought’s needed reference to facts and reality, and it expresses concern with relevance (Sachbezug). It is indicative of Oehler’s rejection of “all idealistic speculation,” and his “radical critique of idealism and utopian thinking” (Hingst and Liatsi, p. 9). If a concept, or thought, is not only something one can be aware of but also something which, unlike everything else, can be the same for every thinker, then language is a problem for thinkers. Although a linguistic sign is not itself a concept, but rather is only used to signify a concept, signs are required to think concepts—or, at least, to think the relations of concepts—and the use of linguistic signs may sometimes lead to confusion, for two signs may (...) be used to signify one concept, and one sign may be used to signify two concepts. A thinker may attempt to avoid confusion by using only one sign to signify one concept, but it may be that in any given language there is only one sign with which to signify two concepts. In this case the thinker may borrow a sign from a foreign language or invent a new sign to signify one of the two concepts. A similar problem arises for a thinker who discovers a concept, and may signify it by either using a sign in the given language, borrowing a sign from a foreign language, or inventing a new sign. Even with all these precautions, however, a thinker may occasionally lapse into using one sign to signify two concepts, and this presents a problem for anyone interpreting the thinker’s utterances and written texts. For years, the collection of DNA samples from individuals arrested for criminal misconduct has been advocated by police officials and endorsed by politicians. Louisiana, Virginia, California, and South Dakota have adopted laws to add DNA profiles derived from these samples to their DNA databases. Texas provides for DNA to be taken after indictment but before conviction. Although the U.S. Department of Justice initially shied away from the issue, the DNA Fingerprint Act of 20055 authorizes the collection of DNA from individuals (...) arrested for violations of certain federal criminal laws, and the inclusion in the national DNA database of all profiles from states that type DNA prior to conviction.But are these laws constitutional? In an article in a previous issue of this journal, and reprinted in this issue, Professor Tracey Maclin concludes that fidelity to precedent should lead the Supreme Court to strike down the Louisiana and Virginia laws as violations of the Fourth Amendment. Sachverhalt zu schaffen. Die Schaffung dieser Grundlage ist das Ziel der vorliegenden Untersuchung. Dies erfordert einerseits nichts Geringeres als eine Darstellung (...) dessen, was das Selbst oder die »Selbigkeit« von Heideggers Sein selbst, was m.a.W. die ontologische Differenz des Seins und was die Seinsverlassenheit sein soll. Ich behandle die Frage, welche Bedeutung die Einheit von Gedanke und Sache hat, die Hegel als Grundvoraussetzung der Wissenschaft der Logik einführt, wenn man sie als Definiens des Logischen selbst fasst. Ich versuche die Frage vor allem durch eine Auslegung ausgewählter Abschnitte in dem Kapitel „Kraft und Verstand, Erscheinung und übersinnliche Welt” in der Phänomenologie des Geistes zu klären. Hegel exponiert hier das Resultat der Dialektik des Kapitels „Die Wahrnehmung oder das Ding und die Täuschung” als „Einheit des Fürsichseins und (...) des Für-ein-Anderes‑Seins” und bemerkt zu diesem Resultat: „Es scheint zunächst nur die Form der Momente zu betreffen; aber das Fürsichsein und das Für-Anderes-Sein ist ebensowohl der Inhalt selbst, …” Ich verstehe diese Einheit als die von Gedanke und Sache. Diese Einheit tritt ein, wenn man die Kategorien, wie Hegel sich in der Logik und der Enzyklopädie ausdrückt, an ihnen selbst betrachtet. Den Zusammenhang der spekulativen Betrachtung und der Einheit von Gedanke und Sache bestimme ich folgendermaßen: Eine Kategorie wird an ihr selbst betrachtet, wenn sie weder auf Instanzen eines außerlogischen Applikationsbereichs bezogen, noch als Inhalt höherstufiger Prädikationen thematisiert wird. Wenn man z.B. das Eidos „Unterschied” an ihm selbst betrachtet, denke ich es als die Sache „Unterschied”, d.h. als Unterscheiden. Die Einheit von Gedanke und Sache ergibt sich von selbst und ist nicht das Resultat einer Interpretation oder äußeren Manipulation. Means–ends decoupling has recently been suggested as one consequence of the problems organizations face in trying to comply with institutional rules in contexts of institutional complexity. Such decoupling is characterized by the adoption, implementation, and scrutiny of particular codes of practice, which tend not to deliver the outcomes they were developed to produce. Recent scholarship focusing on this issue has suggested that such decoupling is a consequence of the trade-off organizations need to make between compliance and goal achievement, most especially (...) when the latter is difficult to evaluate. Although recent scholarship has suggested that this tension might be mitigated by the activities of developers of compliance rules, in this article, we explore how actors internal to organizations, in this case, two charitable organizations, mitigate this tension via nonconformance with particular codes. We focus on how the process of accounting for nonconformance results in the discursive coupling of means and ends as actors creatively develop vocabularies of motive, which respond to anticipated social criticism. Community Engagement (CE) has been presented by bio-ethicists and scientists as a straightforward and unequivocal good which can minimize the risks of exploitation and ensure a fair distribution of research benefits in developing countries. By means of ethnographic fieldwork undertaken in Kenya between 2007 and 2009 we explored how CE is understood and enacted in paediatric vaccine trials conducted by the Kenyan Medical Research Institute and the US Centers for Disease Control (KEMRI/CDC). In this paper we focus on the role (...) of paid volunteers who act as an interface between villagers KEMRI/CDC. Village Reporters’ (VRs) position of being both with the community and with KEMRI/CDC is advantageous for the conduct of trials. However it is also problematic in terms of exercising trust, balancing allegiances and representing community views. VRs role is shaped by ambiguities related to their employment status and their dual accountability to researchers and their villages. VRs are understandably careful to stress their commitment to self-less community service since it augments their respectability at community level and opens up opportunities for financial gain and self-development. Simultaneously VRs association with KEMRI/CDC and proximity to trial participants requires them to negotiate implicit and explicit expectations for material and medical assistance in a cultural setting in which much importance is placed on sharing and mutuality. To ensure continuity of productive interactions between VRs, and similar community intermediaries, and researchers, open discussion is needed about the problematic aspects of relational ethics, issues concerning undue influence, power relations and negotiating expectations. Increasing numbers of corporations are mobilising themselves to put more and more information out into the public domain as a way of communicating with stakeholders. Corporate social accounting and stakeholder engagement is happening on an unprecedented scale. Rather than welcoming such initiatives, academics have been quick to pick faults with contemporary social auditing and reporting, claiming that in its current form it is not about demonstrating accountability at all, (...) but rather about building corporate reputation. Academics argue that ‘accountability should hurt’, that if accountability is an enjoyable process, then the organisation isn’t doing it right. For organisations that are currently engaging with stakeholders and ostensibly becoming more transparent about their corporate social performance, this kind of critique is likely to be bewildering. This paper argues that central to the notion of accountability and to contemporary social accounting practice is the concept of trust. Accountability is based upon a distrust of corporate management, whereas corporate reputation building is about strategically seeking to establish trust in stakeholder relationships in order to negate formal accountability requirements. Using a split trust continuum, the paper seeks to explain and synthesise what seem to be two very different paradigms of organisational transparency. (shrink)

Real-world judgements and decisions often require choosing from an open-ended set of options which cannot be exhaustively considered before a choice is made. Recent work has found that the options people do consider tend to have particular features, such as high historical value. Here, we pursue the idea that option generation during decision making may reflect a more general mechanism for calling things to mind, by which relevant features in a context-appropriate representational space guide what comes to mind. In this (...) paper, we evaluate this proposal primarily based on what comes to mind in different familiar categories. We first introduce an empirical approach for deriving the space of features that people use to represent items in a particular category and for locating the category members that come to mind within that space. We show that in both familiar and ad hoc categories, a category member’s location along certain dimensions of the derived feature space predicts its likelihood of coming to mind. Next, we show that category members from these feature space locations come to mind by default in a way that is somewhat impervious to conscious control. We then demonstrate that the extent to which a given dimension is a predictor of what comes to mind within a category is related to how relevant that feature is for representing the category in question, using a novel measure of general feature relevance. Finally, we illustrate the usefulness of this framework in the context of a decision making task. We close with the proposal that people call category members to mind according to their location in representational space, specifically based on the predicted usefulness of considering category members with particular features. Descriptions of how people use time can tell us much about quality of life, social and economic well-being, and patterns of leisure, work, travel, and communication. Self-administered activity diaries are one of the main methods available for capturing data on time use. This paper discusses some of the methodological issues surrounding the use of self-administered activity diaries as a tool for capturing data on communication and travel activities. Its main concern is to highlight the lessons learnt from the use of (...) self-administered activity diaries as a supplementary method of data collection in a recent study. This study assessed whether different levels of access to, and use of, Information and Communication Technologies (ICTs) enable different paces of life in different communities, and how this process might be contributing to social and spatial polarisation. The insights gained into how activity dairies can be successfully applied are relevant to research within any discipline where this method of data collection is being considered. (shrink)

Self-plagiarism requires clear definition within an environment that places integrity at the heart of the research enterprise. This paper explores the whole notion of self-plagiarism by academics and distinguishes between appropriate and inappropriate textual re-use in academic publications, while considering research on other forms of plagiarism such as student plagiarism. Based on the practical experience of the authors in identifying academics’ self-plagiarism using both electronic detection and manual analysis, a simple model is proposed for identifying self-plagiarism by academics.

This paper reports on a study of teachers’ perceptions of teaching and learning in Scotland during the COVID-19 pandemic through the lens of engaged pedagogy and the ideas of bell hooks. It aimed to explore the different ways that teachers experienced teaching and learning during this time and the impact this may have had on teacher identity. Sixty teachers and head teachers were interviewed using MS Teams in the period April-June, 2020. For this paper, 18 transcripts were analyzed by members (...) of the research team. Four key themes emerged from the interview data: Working from home, parental engagement, teacher identity, and changes in pedagogy. Each of these themes were discussed in terms of concepts such as engaged pedagogy, agency, self-actualization, recognition and boundary transgression situated in the work of bell hooks. The idea of boundaries wove itself throughout our data as teachers expressed how the transgression of boundaries was occurring in multiple, and often contradictory, ways in pedagogical, professional, institutional and personal spaces and systems. We see in our data evidence of a shift in practice not just in the way teachers are ‘doing’ education but also, perhaps, in the way that teachers are ‘being’ as educators as they adapt to different ways of knowing. This study provides a unique exploration of a time and space in Scotland during 2020. However, the themes and understandings that emerged are of relevance to educators internationally. Schools across the world were impacted by various lockdowns imposed by the Covid-19 pandemic and teachers faced a common set of challenges that were resolved via re-negotiation and recognition of individual and collective agency to create new pedagogies. Dreaming is often characterized as lacking high-order cognitive skills. In two studies, we test the alternative hypothesis that the dreaming mind is highly similar to the waking mind. Multiple experience samples were obtained from late-night REM sleep and waking, following a systematic protocol described in Kahan . Results indicated that reported dreaming and waking experiences are surprisingly similar in their cognitive and sensory qualities. Concurrently, ratings of dreaming and waking experiences were markedly different on questions of general reality orientation and (...) logical organization . Consistent with other recent studies , experiences sampled from dreaming and waking were more similar with respect to their process features than with respect to their structural features. (shrink)

This paper contends that principles of virtue ethics have the potential to both supplement and complement academic integrity policy in the adjudication of undergraduate student academic integrity breaches. The paper uses elements of grounded theory to explore responses from 15 Academic Integrity Breach Decision Makers at an Australian university, and in particular, the process they use to determine outcomes for student breaches of academic integrity. The findings indicate that AIBDMs often use principles of virtue ethics to help provide nuanced judgement (...) on sometimes complicated breaches of ethical behaviour. The findings demonstrate that many AIBDMs supplemented their knowledge of institutional academic integrity policy with a deep commitment to their own virtuous behaviour. (shrink)

The musha mukadzi (Shona) or umuzi ngumama (Ndebele) is an African gendered philosophy that means women make up the home. This philosophy has been researched in African traditional religions (ATRs) and is interrogated from interdisciplinary angles in academia. African feminist research has highlighted how this philosophy can be derogatory, stereotyped and oppressive to women if it is naïvely used in domestic contexts. As a result, contemporary African feminists and gender scholars attempt to expose both the liberative and oppressive nature of (...) this philosophy. This study seeks to interrogate how women from the grassroots understand this philosophy. It draws from in-depth interviews with women from Zimunya, Mutare, in Zimbabwe who describe this philosophy as a resource for sustainable livelihoods. Methods used to collect data involved in-depth interviews from a sample of 10 women whose ages ranged from 35 to 50 years. The findings highlight that for both single and married women in Zimunya, the musha mukadzi or umuzi ngumama philosophy has empowering traits that enhance women’s agency and sustainable livelihoods in the domestic household. They describe how this philosophy has empowered them to initiate income-generating projects that include rearing of poultry (road runners), membership to a sewing club, selling dried traditional foods and money savings (mikando).Contributions: This article explores an African gendered philosophy, musha mukadzi or umuzi ngumama [women make the home], and how this has been used as a resource by women in sustaining livelihoods. The findings highlight that for both single and married women in Zimunya, the musha mukadzi or umuzi ngumama philosophy has empowering traits that enhance women’s agency and sustainable livelihoods in the domestic household. They describe how this philosophy has empowered them to initiate income-generating projects that include rearing of poultry (road runners), membership to a sewing club, selling dried traditional foods and money savings ( mikando ). This study examines the relationship between gender, class, and race through a case study of the Ontario, Canada dental profession in the first two decades of the twentieth century. During this time period dentists endeavored to solidify their claims to professional status by defining their relations with patients, the public, and with dental assistants. Dentists drew on gender, class, and racial-ethnic relations and ideology in defining these relations and fostering their professional identity. As a result of the COVID-19 pandemic people have endured potentially stressful challenges which have influenced behaviors such as eating. This pilot study examined the effectiveness of two brief interventions aimed to help individuals deal with food cravings and associated emotional experiences. Participants were 165 individuals residing in United Kingdom, Finland, Philippines, Spain, Italy, Brazil, North America, South Korea, and China. The study was implemented remotely, thus without any contact with researchers, and involved two groups. Group one participants were requested (...) to use daily diaries for seven consecutive days to assess the frequency of experience of their food cravings, frequency of giving in to cravings, and difficulty resisting cravings, as well as emotional states associated with their cravings. In addition to completing daily food diaries, participants in group two were asked to engage in mindful eating practice and forming implementation intentions. Participants assessed their perceived changes in eating, wellbeing, and health at the beginning and end of the intervention. Repeated measures MANOVAs indicated that participants experienced significantly less food cravings, as well as lower intensities of unpleasant states associated with cravings across time. In contrast to our hypothesis, the main effects of the group were not significant. Participants reported less eating and enhanced wellbeing at the end of the study. Our findings can be used to inform future remote interventions to manage food cravings and associated emotions and highlight the need for alternative solutions to increase participant engagement. The transforming growth factors beta are a family of peptides which are involved in the regulation of cell growth and differentiation. It has been suggested that the loss of sensitivity to growth inhibition by endogenous TGF‐β may contribute to the process of carcinogenesis in epithelial systems. However, many breast cancer cells remain sensitive to the growth inhibitory effects of these peptides, suggesting that the local induction of TGF‐β could provide a pharmacological approach to chemoprevention. Triphenylethylene anti‐oestrogens, synthetic progestins and retinoids (...) all offer potential as chemopreventative agents. A common feature of their mechanism of action is the ability to locally increase the production of the transforming growth factors beta. (shrink)

In 2014, Lord Saatchi launched his ultimately unsuccessful Medical Innovation Bill in the UK. Its laudable aim was to free doctors from the shackles that prevented them from providing responsible innovative treatment. Lord Saatchi’s principal contention was that current law was the unsurmountable barrier that prevented clinicians from delivering innovative treatments to cancer patients when conventional options had failed. This was because doctors feared that they might be sued or tried and convicted of gross negligence manslaughter if they deviated from (...) standard practice. Concerns about fear of the law and potential negative effects on medical practice are not new. Fear of litigation has been suggested as the reason for doctors practising “defensive medicine,” by opting for treatments regarded as “grievance-resistant,” rather than clinically indicated, for example, by ordering diagnostic tests or performing certain procedures, which are not strictly medically necessary. Whilst this claim is plausible and apparently accepted by the courts, there is limited empirical evidence in support of it so far as practitioners in the UK are concerned. In this paper, we report on our empirical research which provides a snapshot of medical opinion to begin to rectify this gap. We ran focus groups of different medical specialties, asking what these medical practitioners thought the barriers to medical innovation to be. We found that fear of the law was not the principal barrier to be lowered, and that the answer was far more multifaceted. (shrink)

In the past twenty years, advances in forensic DNA technology have revolutionized the American criminal justice system. The use of forensic DNA testing in America began in 1987, and its demonstrated scientific accuracy quickly led jurisdictions to accept expert testimony regarding DNA matches between suspects and crime scene evidence. Wielding the power to exonerate the innocent and apprehend the guilty, the use of DNA identification technology has become an indispensable resource for prosecutors and law enforcement officials, as well as for (...) defense lawyers representing persons falsely accused or wrongfully convicted of crimes they did not commit. As states began to compile DNA profiles from convicted offenders, the need for a repository for these profiles resulted in the DNA database.Originally, DNA databases included only “those classes of offenders with a high recidivism rate, such as sex offenders and violent felons.” Recognizing the crime-solving potential of this technology, state legislatures soon began to expand the scope of DNA database statutes to include broader classes of offenders.
